Retailers to be consulted on new legislation for protection from terrorist attacks

The Government is currently consulting with the public and retailers to seek their views on proposed legislation requiring the occupiers of "publicly accessible locations" to implement measures to protect employees and members of the public in the event of a terrorist attack.

The proposed legislation

The proposed legislation will apply to all premises accessible by the public (whether or not access is controlled), including high streets, shops, shopping centres and markets.

Measures in the proposed legislation include:

• risk assessing security threats;
• carrying out staff training and awareness programmes; and
• implementing security measures for crime prevention and anti-social behaviour.

The proposed legislation is intended to apply to premises that can cater for at least 100 people, but could potentially apply to shops with few staff in a shop with a capacity of less than 100 customers. The consultation document can be read in full here.

The Government has published a survey (here) which retailers can complete and submit (up until 2 July 2021). Retailers can also send their thoughts by email or post to the home office, using the details here.

A paper summarising the responses to the consultation will be published and will be made available online here. The Government will also use the responses to the consultation and the additional research and analysis work to develop a Regulatory Impact Assessment.
